1. Agreement to Terms

By accessing and purchasing from simonrobinstephensart.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Artwork Sales

2.1 Original Artworks

• All original watercolour paintings are one-of-a-kind pieces
• Each artwork is signed and comes with a certificate of authenticity
• Prices include the artwork only; framing is not included unless specified
• Artworks are sold on a first-come, first-served basis

2.2 Prints

• Prints are high-quality reproductions of original artworks
• Prints are supplied on archival quality paper
• Print runs are not limited unless otherwise stated

2.3 Pricing

All prices are displayed in British Pounds (GBP) and include VAT where applicable. Prices are subject to change without notice, but orders confirmed will honor the price at the time of purchase.

3. Payment

• Payment is processed securely via SumUp payment gateway
• We accept major credit and debit cards
• Payment must be received in full before artwork is shipped
• For commissions, a 50% non-refundable deposit is required to begin work

4. Commissions

1. Initial consultation to discuss your requirements
2. Written quote provided including timeline and price
3. 50% deposit required to begin work
4. Progress updates provided during creation
5. Final approval before shipping
6. Balance payment required before delivery

4.2 Commission Terms

• Typical turnaround time is 4-8 weeks depending on complexity
• Minor revisions are included; significant changes may incur additional fees
• Deposits are non-refundable once work has commenced
• Copyright remains with the artist unless otherwise agreed in writing

5. Shipping & Delivery

• UK orders: 3-5 working days via Royal Mail Tracked 48
• International orders: 7-14 working days via Royal Mail International Tracked
• All artworks are fully insured during transit
• Risk of loss passes to the buyer upon delivery

6. Returns & Refunds

6.1 Original Artworks

You may return an original artwork within 14 days of receipt for a full refund if:

• The artwork is in its original condition
• All packaging materials are retained
• You contact us before returning
• Return shipping costs are your responsibility

6.2 Prints & Cards

Prints and cards are non-returnable unless damaged or defective. Contact us within 48 hours of receipt with photos of any damage for a replacement or refund.

6.3 Commissions

Commissioned artwork is non-returnable and non-refundable once approved and completed.

7. Copyright & Usage Rights

7.1 Ownership

When you purchase artwork, you own the physical piece but not the copyright. Copyright remains with Simon Robin Stephens.

7.2 Permitted Use

You may:

• Display the artwork in your home or business
• Take photographs for personal use
• Share images on social media with credit to the artist

7.3 Prohibited Use

You may not:

• Reproduce the artwork for commercial purposes
• Create derivative works based on the artwork
• Sell or license reproductions without written permission

8. Limitation of Liability

Simon Robin Stephens and simonrobinstephensart.com shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of artwork or this website. Our liability is limited to the purchase price of the artwork.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page with an updated revision date. Continued use of the site after changes constitutes acceptance of the modified terms.
